Terms of Service
Standard contractual terms governing fine art print purchases, commercial photography services, private client proofing portals, and intellectual property ownership.
1. Copyright & Exclusive Intellectual Property
All photographs, concert imagery, prints, audio-visual recordings, digital proofs, written editorial, and brand assets displayed on darkstudiofilms.com are the exclusive intellectual property of Dark Studio Films (Dodgeville, Wisconsin) and photographer Dan, protected under the Copyright Act of 1976, Title 17 of the United States Code, and international copyright treaties (Berne Convention).
Physical Ownership vs. Copyright: Purchasing a physical fine art print or receiving a print through a promotional campaign transfers physical ownership of that specific tangible print only. It does not convey or transfer any copyright, licensing, reproduction, scanning, commercial exploitation, or digital redistribution rights.
Under no circumstances may any photograph, artwork, or print be digitized, reproduced, resold, sublicensed, published, or utilized for generative artificial intelligence (AI) model training without an explicit, executed commercial licensing agreement signed by Dark Studio Films.
2. Print Store & Custom Made-to-Order Production
Every fine art print offered through the Dark Studio Films store is custom-produced upon placement of order. We utilize museum-grade archival pigment inks, heavyweight fine art cotton papers (e.g. Hahnemühle), and precision hand-crafted frames.
Because each piece is custom-printed, calibrated, cured, and hand-packaged specifically for your order in Dodgeville, WI, all print sales are final. Orders enter production immediately upon payment confirmation and cannot be canceled, amended, or recalled once printing has commenced.
3. Limited Edition Runs
Photographs designated as Limited Edition are strictly capped at the published edition quantity for each respective size and specification. Once a limited edition tier sells out, it is permanently closed, and no further prints of that specification will ever be produced.
4. Pricing, Taxes & Currency
All prices listed on the website and print store are denominated in United States Dollars (USD). Applicable state and local sales taxes (including Wisconsin sales tax where required by law) and courier shipping rates are calculated and displayed at checkout prior to final payment authorization.
5. Client Proofing Portal & Digital Deliverables
Access to private client galleries and media proofing portals (/portal/[code]) is strictly restricted to designated production clients, artists, management, and venues. Access codes are confidential and non-transferable.
Digital downloads and media usage rights granted through client portals are governed strictly by the underlying photographic production agreement executed between Dark Studio Films and the client.
6. Limitation of Liability & Governing Law
To the maximum extent permitted by applicable law, Dark Studio Films shall not be liable for any indirect, incidental, or consequential damages resulting from website usage or courier transit delays.
These Terms of Service are governed by and construed in accordance with the laws of the State of Wisconsin, without regard to conflict of law principles. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Wisconsin.
